General Terms and Conditions of Service

This document sets out the General Terms and Conditions (hereinafter, the "Terms") that govern the contractual relationship between MI VUELTA (hereinafter, "the Company", "we" or "Mi Vuelta") and any natural or legal person who contracts our replacement driver, valet parking, event transport and related services (hereinafter, "the Client" or "the User").

Contracting any service offered by Mi Vuelta implies full, unconditional and unreserved acceptance of these Terms in their entirety. If the Client does not agree with any of the provisions contained herein, they must refrain from using our services.

1. Definitions

  • Comprises the driving of the Client’s vehicles by drivers designated by Mi Vuelta, including but not limited to: angelito service (replacement driver), valet parking, event transport, and special transfers."Service":
  • A natural person of legal age, duly licensed to drive, who provides driving services on behalf of Mi Vuelta."Driver" or "Angelito":
  • A car, pickup truck or other motorized vehicle owned by the Client or under their legal custody, which will be driven during the provision of the Service."Vehicle":
  • A formal request by the Client for the provision of a Service on a specific date, time and under specific conditions."Booking":
  • Location where the Driver picks up the Client and/or their Vehicle."Point of Origin":
  • The agreed final location where the Driver will deliver the Client and/or their Vehicle."Point of Destination":

2. Nature of the Service and Contractual Relationship

  • Mi Vuelta acts as an intermediary in the provision of driving services, providing qualified drivers to operate vehicles owned by third parties.
  • The relationship between Mi Vuelta and the Client is strictly commercial and one of service provision. There is no employment, dependency or subordination relationship between the parties.
  • Mi Vuelta is not the owner, lessee or possessor of the vehicles driven. The Client retains at all times the ownership, possession and legal responsibility over their vehicle.
  • The Client acknowledges and accepts that Mi Vuelta acts as an intermediary in the provision of the driving service.

3. Client Requirements and Obligations

  • The Client warrants that the vehicle has all current legal documentation, including: a valid circulation permit, an approved technical inspection, valid mandatory insurance (SOAP), and motor insurance covering own and third-party damage.Vehicle Documentation:
  • The Client declares that the vehicle is in optimal mechanical condition to circulate, with all of its safety systems working correctly (brakes, lights, tires, steering, etc.).Condition of the Vehicle:
  • The Client undertakes to provide truthful and complete information about the vehicle, including any peculiarity, known defect or special operating condition.Truthful Information:
  • The Client must be present and reachable at the Point of Origin at the agreed time, with the vehicle keys and in a position to hand it over to the Driver.Presence and Availability:
  • The vehicle must have sufficient fuel to complete the agreed journey. Mi Vuelta is not responsible for incomplete services due to a lack of fuel.Fuel:
  • The Client is responsible for removing from the vehicle any valuables, important documents or personal belongings before the service is provided.Valuables:

4. Cancellation and Refund Policy

  • The Client may request a refund of the amount paid, subject to a 15% deduction for administrative management costs.Cancellation more than 24 hours in advance:
  • No refunds will be made under any circumstances. The amount paid will be considered compensation for reserving the availability of the service.Cancellation less than 24 hours in advance:
  • If the Driver arrives at the agreed Point of Origin and the Client is not present, does not respond to contact attempts, or the vehicle is not available, after 15 minutes have elapsed from the agreed time, the service will be deemed effectively provided and no refund will apply.No-Show:
  • In the event that Mi Vuelta must cancel a service for reasons of force majeure or lack of availability, a full refund of the amount paid will be made or the service rescheduled, at the Client’s preference.Cancellation by Mi Vuelta:

5. Waiting Times and Surcharges

  • A waiting period of 15 minutes at no additional cost is granted, counted from the agreed service start time.Grace Period:
  • Once the grace period has elapsed, the Driver may, at their discretion:Additional Waiting:
    • Cancel the service with no right to a refund for the Client.
    • Continue waiting with a surcharge of $10,000 (ten thousand Chilean pesos)
      for each additional 30-minute increment of waiting.
  • The Client must report any delay in advance. Failure to communicate will be considered abandonment of the service.Communication:

6. Modifications to the Contracted Service

  • Each stop not included in the original booking will incur a surcharge of $6,000 (six thousand Chilean pesos). Stops must be coordinated and approved in advance.Additional Stops:
  • If the Client requests a destination different from the one agreed, or leaves the Driver at a location other than the original Point of Destination, the cost of the Driver’s return transport (taxi, Uber, public transport or other means) will be charged additionally and invoiced to the Client afterwards.Change of Destination:
  • Any modification to the booking must be communicated at least 12 hours in advance. Changes requested outside this period are subject to availability and may entail additional charges. No refund is guaranteed if the change cannot be accommodated.Schedule or Address Changes:
  • In the event that the Client or any of their companions vomits inside the vehicle, or leaves it in a condition that requires professional cleaning or special sanitization (spills, bodily fluids or other soiling of equivalent magnitude), a one-time charge of $100,000 (one hundred thousand Chilean pesos) will apply for cleaning, sanitization and lost profit for the time during which the vehicle cannot be used. This charge will be collected at the end of the service or invoiced to the Client afterwards.Cleaning for Vomit or Major Soiling:

7. Impossibility of Providing the Service

  • If the service cannot be provided due to causes attributable to the Client or to the condition of their vehicle, no refund of the payment will apply. These causes include, by way of illustration but not limitation:
  • Vehicle without keys or with a faulty ignition system
  • Insufficient fuel for the journey
  • Mechanical defects that prevent safe driving
  • Discharged battery or faulty electrical system
  • Tires in poor condition or without air
  • Expired or non-existent vehicle documentation
  • Vehicle immobilized due to debts, judicial or administrative orders
  • Any other condition that, in the Driver’s judgment, compromises the safety of the service

8. Force Majeure and Fortuitous Events

  • Mi Vuelta will not be responsible for breaches, delays or the impossibility of providing the service when these are the consequence of force majeure or fortuitous events, understood as those events that are unforeseeable or that, although foreseeable, are unavoidable. These include, by way of illustration:
  • Natural phenomena: earthquakes, floods, storms, volcanic eruptions
  • Extreme weather conditions that prevent safe driving
  • Traffic accidents that block the roads
  • Demonstrations, protests, strikes or civil disturbances
  • Road closures due to works, emergencies or decisions by authorities
  • Health emergencies, pandemics or quarantines
  • Acts of terrorism or war
  • Massive failures of public services or infrastructure
  • Any other circumstance beyond the reasonable control of Mi Vuelta
  • In these cases, no refund of the payment made will apply.

9. Exceptional Refund Policy

  • Exceptionally, Mi Vuelta may assess refund requests in cases of force majeure duly substantiated by the Client, provided that:
  • The request is submitted at least 48 hours in advance of the scheduled service
  • Documentation is provided that reliably substantiates the cause invoked
  • The situation is considered by Mi Vuelta to merit an exception
  • If the refund proceeds, a minimum of 20% of the amount paid will be deducted for administrative management costs.
  • The decision on exceptional refunds is the exclusive and discretionary power of Mi Vuelta, and its determination is final.

10. Limitation of Liability for Accidents and Claims

ESSENTIAL CLAUSE - READ CAREFULLY

  • It is an indispensable and non-negotiable requirement that the Client’s vehicle has valid motor insurance that includes coverage for own damage, third-party damage and civil liability. The Client declares under oath that their vehicle meets this requirement at the time of contracting the service.Mandatory Insurance:
  • In the event that the vehicle does not have valid insurance, or that the policy does not cover the type of incident that occurred, Mi Vuelta is fully and absolutely exempt from any liability for damages of any nature.Vehicles Without Insurance:
  • In the event of a traffic accident in which the Mi Vuelta Driver is determined to be responsible by the competent authority or by agreement between the parties, Mi Vuelta’s liability will be limited EXCLUSIVELY to payment of the deductible amount established in the insurance policy of the Client’s vehicle.Limitation of Liability:
  • Mi Vuelta will NOT be responsible under any circumstances for:Exclusions of Liability:
    • Consequential or indirect damages of any nature
    • Lost profit or loss of income
    • Loss of use of the vehicle during repairs
    • Moral, psychological or non-pecuniary damages
    • Alternative transport costs during the repair
    • Depreciation of the vehicle due to the incident
    • Increases in future insurance premiums
    • Any other harm not expressly contemplated in this clause
  • Any claim related to accidents must be submitted in writing within 24 hours following the incident, accompanied by: a police record or report, photographs of the vehicle and the location, insurance details, and any other relevant documentation.Claims Procedure:
  • The Client undertakes to cooperate with Mi Vuelta and its insurer in all procedures necessary for the resolution of the incident, including the signing of documents, statements and appearances that may be required.Client Cooperation:

11. General Disclaimer of Liability

  • By contracting the services of Mi Vuelta, the Client expressly and irrevocably releases the Company, its partners, directors, employees, representatives and associated drivers from all civil, criminal or administrative liability arising from:
  • Loss, damage, deterioration or misplacement of personal items, documents, cash, jewelry, electronic equipment or any other property left inside the vehicle.Personal Items:
  • Scratches, dents, aesthetic or mechanical damage pre-existing in the vehicle that has not been duly documented and reported before the start of the service.Pre-existing Damage:
  • Fines, tickets or sanctions arising from the condition of the vehicle (faulty lights, lack of documentation, illegible plates, etc.) or from circulation restrictions unknown to the Driver.Traffic Violations:
  • Any consequence arising from false, inaccurate, incomplete or outdated information provided by the Client.Inaccurate Information:
  • Consequences of the Client’s specific instructions that contravene traffic or safety regulations.Client Decisions:

12. Fees and Payment Conditions

  • Unless expressly agreed otherwise, payment for the service is made upon completion of its provision.Time of Payment:
  • The following methods are accepted: cash in Chilean pesos, electronic transfer, debit and credit cards (Visa, Mastercard, American Express).Payment Methods:
  • Prices may vary depending on: distance of the journey, time of the service (nighttime, holidays), demand at the time, number of stops, and special conditions of the service.Variable Fees:
  • Surcharges for additional stops, exceeded waiting time, changes of destination or any other item will be reported to the Client and collected at the end of the service or invoiced afterwards.Additional Charges:
  • Mi Vuelta will issue a receipt or invoice as appropriate and as requested by the Client.Receipt:

13. Protection of Personal Data

  • Mi Vuelta undertakes to process the Client’s personal data in accordance with the data protection legislation in force.
  • The data collected (name, phone, address, vehicle information) will be used exclusively for the provision of the contracted service and related communication.
  • Mi Vuelta will not sell, rent or share the Client’s personal data with third parties unrelated to the provision of the service, except at the request of a competent authority.
  • The Client may exercise their rights of access, rectification and cancellation of data by contacting Mi Vuelta through the official channels.

14. Intellectual Property

  • All content on the Mi Vuelta website, including text, graphics, logos, icons, images, audio and video clips, and software, is the property of Mi Vuelta or its content providers and is protected by intellectual property laws.
  • The reproduction, distribution, modification or unauthorized use of any content without the express written consent of Mi Vuelta is prohibited.

15. Modification of the Terms and Conditions

  • Mi Vuelta reserves the right to modify, update or supplement these Terms and Conditions at any time and without prior notice.
  • The modifications will take effect from the moment of their publication on the website www.mivuelta.cl
  • Continued use of Mi Vuelta’s services after the publication of modifications implies tacit acceptance of the new terms.
  • The Client is advised to periodically review these Terms in order to stay informed of any changes.

16. Applicable Law and Jurisdiction

  • These Terms and Conditions are governed by the laws of the Republic of Chile.
  • For the resolution of any dispute arising from the interpretation or application of these Terms, the parties submit to the jurisdiction of the Ordinary Courts of Justice of the city of Santiago, Chile, expressly waiving any other jurisdiction that might apply to them.

17. Severability

  • If any provision of these Terms is declared null, invalid or unenforceable by a competent court, such nullity will not affect the validity of the remaining provisions, which will retain their full force and effect.
